Building the Evidentiary Record: Keep the Three Questions Separate

Pleadings identify the dispute; discovery develops the information needed to resolve it; summary judgment asks whether the developed record presents a genuine dispute of material fact requiring trial. Exam traps routinely blur these three distinct legal thresholds:

QUESTION 1 • DISCOVERY FRCP 26(b)(1)

May this information be discovered?

Permits discovery of nonprivileged matter that is relevant to any party's claim or defense AND proportional to the needs of the case.

Key Distinction: Information need NOT be admissible at trial to be discoverable. However, the pre-2015 phrase "reasonably calculated to lead to admissible evidence" was eliminated and is obsolete!
QUESTION 2 • ADMISSIBILITY FRE 401, 501, 802

May it be presented as evidence?

Governs whether information obtained in discovery satisfies the Federal Rules of Evidence (relevance, personal knowledge, authenticity, hearsay exceptions, privilege).

Key Distinction: A hearsay note may be discoverable under Rule 26(b)(1) because it identifies an eyewitness, even though the note itself is inadmissible at trial to prove its contents.
QUESTION 3 • TRIAL NEED FRCP 56(a), (c)

Does the evidence require a trial?

Summary judgment is required when there is no genuine dispute as to any material fact and the movant is entitled to judgment as a matter of law.

Key Distinction: Record material need not be in final trial form (e.g., a sworn declaration), but its contents must be capable of admissible presentation at trial (Rule 56(c)(2)).
