The Out-of-State Vehicle Purchase (*Ford Motor Co.* Analysis)
View Doctrinal Model Solution ▼
1. General Jurisdiction: Under Daimler AG v. Bauman (2014) and Goodyear, Ford is not essentially at home in Montana. Continuous and systematic commercial sales do not establish general all-purpose jurisdiction outside the state of incorporation (Delaware) or nerve center (Michigan).
2. Specific Jurisdiction: Controlled directly by Ford Motor Co. v. Montana Eighth Judicial District Court, 592 U.S. 351 (2021). The Due Process Clause requires that the claim "arise out of or relate to" the defendant's contacts with the forum.
3. Causation Not Strictly Required: The Supreme Court rejected Ford's argument that a strict causal chain (but-for or proximate cause) is required. Because Ford systematically urged Montanans to buy and drive Explorers, distributed replacement parts, and operated repair centers in Montana, there was a strong affiliation between Ford's purposeful forum conduct and the in-state injury. Montana properly exercises specific personal jurisdiction.
The Florida Journalist & California Celebrity (*Calder* Effects Test)
View Doctrinal Model Solution ▼
1. The Calder Effects Test: Under Calder v. Jones, 465 U.S. 783 (1984), purposeful availment in intentional tort cases is satisfied via "purposeful direction" when the defendant: (a) commits an intentional act, (b) expressly aimed at the forum state, (c) causing harm that defendant knows is likely to be suffered in the forum state.
2. Application: The writers drew their information from California sources, wrote about activities in California, knew the plaintiff lived and worked in California where the brunt of the reputational injury would be suffered, and wrote for a publication with huge California circulation. Jurisdiction is constitutionally proper over both individuals.
3. Contrast with Walden v. Fiore: Under Walden v. Fiore (2014), the mere fact that a plaintiff feels injury in the forum is insufficient unless the defendant deliberately targeted the forum itself. Here, defendants expressly aimed their reporting at California.
Corporate Residency & Multi-District States (28 U.S.C. § 1391(c)(2) & (d))
View Doctrinal Model Solution ▼
1. Multi-District State Rule (28 U.S.C. § 1391(d)): For venue purposes, a corporation is deemed to reside in any district where it would be subject to personal jurisdiction if that district were a separate State.
2. Analysis: If the Southern District of New York were its own State, MegaCorp would have NO personal jurisdiction there: it has no general jurisdiction (nerve center is Buffalo in WDNY), no contacts, and the contract events occurred in Buffalo. Thus, MegaCorp does NOT reside in SDNY under § 1391(b)(1).
3. Remedy: Because substantial events occurred in the Western District of New York, venue is improper in the Southern District. Under 28 U.S.C. § 1406(a), the court must dismiss or, in the interest of justice, transfer the case to the Western District of New York.
The Airport Service & Untimely Objection (*Burnham* & Rule 12(h)(1))
View Doctrinal Model Solution ▼
1. Transient "Tag" Jurisdiction: Under Burnham v. Superior Court, 495 U.S. 604 (1990), voluntary physical presence in the forum at the moment of in-hand service confers constitutional personal jurisdiction over a natural person without requiring minimum contacts.
2. Rule 12(g) & (h)(1) Waiver Trap: Even if Defendant had a colorable objection, Defendant omitted the defense of lack of personal jurisdiction and improper venue from Defendant's initial pre-answer Rule 12 motion. Under the strict omnibus rule of Rule 12(g)(2) and Rule 12(h)(1)(A), personal jurisdiction and venue objections are permanently WAIVED.
The Foreign Plane Crash & Transfer (*Piper Aircraft v. Reyno*)
View Doctrinal Model Solution ▼
1. Forum Non Conveniens Standard: Controlled by Piper Aircraft Co. v. Reyno, 454 U.S. 235 (1981). Transfer under 28 U.S.C. § 1404(a) is impossible because the alternate forum is foreign (Scotland).
2. Less Favorable Substantive Law: The Supreme Court held that the possibility of an unfavorable change in substantive law does NOT bar dismissal on forum non conveniens, unless the remedy provided by the alternative forum is so clearly inadequate that it is no remedy at all (which Scotland is not).
3. Private and Public Interest Factors: All physical evidence, wreckage, witnesses, air traffic records, and investigators are located in Great Britain. Dismissal without prejudice is appropriate, usually conditioned on defendants submitting to Scottish jurisdiction and waiving statute of limitations defenses.
⚠️ The 8 Fatal Civil Procedure Exam Traps
Memorize these distinctions. They constitute the most frequently tested tricks on law school exams and the Multistate Bar Examination (MBE).
Proper venue under 28 U.S.C. § 1391 does not confer personal jurisdiction. Both must be independently satisfied. A court can have perfect venue but zero PJ over an out-of-state defendant.
SMJ concerns the court's constitutional power over the type of case (diversity or federal question). PJ concerns power over the defendant. Having § 1332 diversity never automatically grants PJ!
A defendant waives PJ and Venue objections if omitted from their first Rule 12 response (Rule 12(h)(1)). In contrast, SMJ can never be waived and can be raised at any time, even on appeal (Rule 12(h)(3)).
Under Daimler (2014) and Goodyear (2011), doing billions in continuous sales does NOT create general jurisdiction. A corporation is subject to general jurisdiction only where it is "essentially at home": State of Incorporation and Principal Place of Business.
Complying with Rule 4 does not automatically guarantee constitutional notice if plaintiff knows service failed. Under Mullane and Jones v. Flowers, if certified mail notice is returned unclaimed, due process requires taking additional reasonable steps.
Specific jurisdiction does not require strict but-for or proximate causation between defendant's forum contacts and the plaintiff's injury. An affiliation where the defendant systematically cultivated the market for that product suffices.
Under Rule 4(d)(5), signing a waiver of service of process expressly preserves all objections to personal jurisdiction and improper venue. It only waives service of formal summons!
If original venue was PROPER, transfer is under § 1404(a) (transferor law usually follows). If original venue was IMPROPER, transfer is under § 1406(a) (or dismissal; transferee law applies).
Landmark Supreme Court Precedents
| Case | Citation | Core Holding / Doctrinal Rule |
|---|---|---|
| Pennoyer v. Neff | 95 U.S. 714 (1877) | Traditional territorial theory: State has exclusive jurisdiction over persons and property within its borders; in personam requires service within forum. |
| Int'l Shoe Co. v. Washington | 326 U.S. 310 (1945) | Seminal modern test: Due Process requires defendant to have "certain minimum contacts... such that maintenance of suit does not offend traditional notions of fair play and substantial justice." |
| Burger King Corp. v. Rudzewicz | 471 U.S. 462 (1985) | Contracts can establish minimum contacts via purposeful availment (contemplated future consequences, 20-year franchise relationship, choice-of-law clause). |
| Burnham v. Superior Court | 495 U.S. 604 (1990) | Transient physical presence ("tag" jurisdiction) remains constitutional for natural persons voluntarily present in forum when served. |
| Daimler AG v. Bauman | 571 U.S. 117 (2014) | General jurisdiction over corporations is limited to where entity is "essentially at home" (incorporation & principal place of business). Rejecting continuous sales test. |
| Ford Motor Co. v. Mont. Eighth Jud. Dist. | 592 U.S. 351 (2021) | "Arise out of or relate to" does not require strict causation. Purposeful cultivation of forum market for the vehicle model supports specific jurisdiction for in-state accident. |
| Mullane v. Central Hanover Bank | 339 U.S. 306 (1950) | Constitutional notice must be "reasonably calculated, under all the circumstances, to apprise interested parties of the pendency of the action." |
| Piper Aircraft Co. v. Reyno | 454 U.S. 235 (1981) | Forum non conveniens dismissal is appropriate when foreign forum is far more convenient, even if foreign substantive law is less favorable to plaintiff. |
